Alıcı:
Alıcı, hobiyz.com üzerinden alışveriş yapan kişidir. Sipariş sırasında beyan edilen bilgiler esas alınır.

2. Konu

İşbu sözleşmenin konusu, Alıcı’nın hobiyz.com üzerinden elektronik ortamda sipariş verdiği ürünlerin satışı ve teslimine ilişkin tarafların hak ve yükümlülüklerinin belirlenmesidir.

3. Ürün Bilgileri

Satın alınan ürünlerin cinsi, miktarı, modeli, fiyatı ve ödeme bilgileri sipariş özetinde belirtildiği gibidir ve işbu sözleşmenin ayrılmaz bir parçasıdır.

4. Teslimat Şartları

Sipariş edilen ürün, ödeme onaylandıktan sonra 3-5 iş günü içinde kargoya verilir. Ortalama teslim süresi 7 iş günüdür. Teslimat, alıcının sipariş sırasında belirttiği adrese yapılır. Teslimat süresi, kargo şirketi ve teslimat bölgesine göre değişiklik gösterebilir.

5. Ödeme Bilgileri

Ödeme, hobiyz.com üzerinden kredi kartı veya diğer sunulan yöntemlerle yapılır. Ödeme tamamlanmadan sipariş geçerli sayılmaz. Ödeme sonrasında fatura, alıcının e-posta adresine dijital olarak gönderilir.

6. Cayma Hakkı

Alıcı, ürünü teslim aldığı tarihten itibaren 14 gün içinde hiçbir gerekçe göstermeksizin ve cezai şart ödemeksizin sözleşmeden cayma hakkına sahiptir. Cayma hakkı için hobiyzz@gmail.com adresine e-posta ile bildirim yapılmalıdır.

Ürün; kullanılmamış, hasar görmemiş ve orijinal ambalajında olmalıdır. Cayma hakkı kapsamında yapılan iadelerde, kargo ücreti alıcıya aittir. Ürün kusurluysa, iade kargo masrafı Satıcı tarafından karşılanır.

7. Cayma Hakkının Geçerli Olmadığı Durumlar

  • Alıcının özel talepleri doğrultusunda kişiselleştirilmiş ürünler

  • Hijyen açısından iadesi uygun olmayan ürünler

  • Ambalajı açılmış, kullanılmış ya da tekrar satılabilirliği bozulmuş ürünler

8. Sorumluluk ve Garanti

Ürünlerin hatalı olması durumunda, iade ya da değişim sağlanır. Satıcı, ürünün yanlış kullanımından doğabilecek doğrudan ya da dolaylı zararlardan sorumlu tutulamaz. Ürünler, üretici garantisi altındaysa bu bilgiler ürünle birlikte iletilir.

9. Gizlilik ve Kişisel Verilerin Korunması

Alıcı tarafından sağlanan kişisel bilgiler, gizlilik politikası çerçevesinde saklanır ve üçüncü kişilerle yalnızca siparişin gerçekleştirilmesi amacıyla paylaşılır.

10. Uyuşmazlık Durumu

Taraflar arasında doğabilecek uyuşmazlıklarda Birleşik Krallık yasaları geçerli olup, yetkili mahkeme Londra mahkemeleridir.

11. Yürürlük

Alıcı, hobiyz.com üzerinden sipariş vererek bu sözleşmenin tüm maddelerini okuduğunu, anladığını ve kabul ettiğini beyan eder. Sözleşme, sipariş onayı ile birlikte yürürlüğe girer.

 

DISTANCE SALES AGREEMENT

Buyer:
The Buyer is the person who places an order through hobiyz.com. The information provided during the ordering process is considered official and binding.

2. Subject

This agreement outlines the rights and obligations of the parties regarding the sale and delivery of the products ordered electronically by the Buyer from hobiyz.com.

3. Product Information

Details such as the type, quantity, model, price, and payment method of the purchased products are included in the order summary and constitute an integral part of this agreement.

4. Delivery Terms

Products are shipped within 3–5 business days following payment confirmation. The average delivery time is 7 business days. Delivery will be made to the address specified by the Buyer during checkout. Delivery times may vary depending on the courier company and destination.

5. Payment Information

Payment must be completed through credit card or other available options on hobiyz.com. Orders are not considered valid until payment is completed. After payment, an electronic invoice will be sent to the Buyer’s email address.

6. Right of Withdrawal

The Buyer has the right to withdraw from the contract without any justification or penalty within 14 days from the date the product is received. To exercise this right, an email must be sent to hobiyzz@gmail.com.

Returned items must be unused, undamaged, and in their original packaging. Return shipping costs are the responsibility of the Buyer unless the product is defective. In the case of a defect, the return shipping cost is covered by the Seller.

7. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Customized products prepared according to the Buyer’s personal requests

  • Products that are not suitable for return due to hygiene reasons

  • Products that have been opened, used, or altered in a way that prevents resale

8. Liability and Warranty

In case of a defective product, return or exchange will be provided. The Seller is not liable for any direct or indirect damages resulting from misuse of the product. If the product is covered under a manufacturer’s warranty, relevant documents will be included with the delivery.

9. Privacy and Data Protection

Personal information provided by the Buyer is stored in accordance with the privacy policy and is only shared with third parties as necessary to fulfill the order.

10. Governing Law and Dispute Resolution

This agreement is governed by the laws of the United Kingdom. Any disputes arising from this contract shall be handled by the courts of London, United Kingdom.

11. Enforcement

By placing an order through hobiyz.com, the Buyer confirms that they have read, understood, and accepted all the terms of this agreement. The agreement comes into effect upon order confirmation.
